Reply to the protest petition has been filed on behalf of ASI Ashish
and the same stands supplied to counsel for complainant.
At this stage, complainant seeks liberty to withdraw his protest
petition as he does not wish to press the allegations against suspects placed in
column no. 12 as a settlement has been arrived at, between the parties.
Even as per the chargesheet and statement of eye witness u/s 161
Cr.P.C., no other individual apart from the accused persons arrayed in the
chargesheet were present at the spot of the incident.
Thus, vide separate endorsement made by counsel for complainant,
protest petition preferred by the complainant is dismissed as withdrawn.
Arguments heard. Record perused.
Prima facie, charge for offences u/s 323/341/34 IPC & 506(II) IPC is
made out against accused persons. Charge framed separately. Same is explained to
the accused to which he has pleaded not guilty and has claimed trial.
At this stage, victims submit that they wish to compound the offences
u/s 323/341/34 IPC & 506(II) IPC with all the accused on humanitarian grounds
and he does not wish to receive any compensation for the same.
Separate statement of victims recorded to this effect.
In view of statement made, the present case is disposed of as

compounded. Accused Rashid, Aslam, Sadakat, Israr, Abrar and Manawar are
acquitted in the present case.
Surety bonds, if any, discharged. Original documents, if any be
returned to the rightful owner after retaining photocopies of the same on record.
Case property, if any, be released to the rightful owner/claimant.
File be consigned to record room after due compliance.
