Present: Sh. Dharmender Kumar, counsel for complainant through VC.
Complainant is absent.
The complainant has filed an application u/s 175(3) BNSS seeking direction to the
SHO concerned for registration of an FIR on the basis of facts mentioned in the application and for
investigation.
Ld counsel for complainant submits that the complainant had approached the SHO
concerned as well as DCP concerned with the similar complaint. However, no action has been taken
as yet. Hence, it is prayed that necessary directions may be issued to the SHO concerned.
In the circumstances mentioned hereinabove, the SHO concerned is directed to file
status report/action taken report in terms of section 173(1) and 173 (2) stating the following :
1. Whether any complaint had been made by the complainant in the police station concerned.
2. If yes, whether any action has been taken by the police on the said complaint and if any
preliminary enquiry conducted, if yes, what action has been taken?
3. Whether as a result of any investigation/inquiry, any cognizable offence has been made out
against the accused person/s and whether any action has been taken by the police.
4. If yes, whether any FIR has been registered and the stage/status of investigation.
5. If no cognizable offence has been made out, whether the complainant had been informed
accordingly.
Complainant is directed to supply the copy of complaint to Court Official/ Naib court
concerned for handing over the same to SHO concerned.
Put up for filing of report and consideration of the same on 24.09.2025.
Copy of this order be sent to SHO concerned for information and compliance.
