Present: Mr. Deepak Ahalawat and Mr. Rahul Kumar, Ld. Counsel for
complainant alongwith complainant.
Let notice be issued to the proposed accused under Section 223(1) of
BNSS, 2023 along with the copy of the complaint and all the requisite documents on
filing of PF/RC/AD/ speed post, returnable on next date of hearing. Complainant is
directed to file PF and take steps within 30 days from today.
Service of notice be effected through all permissible modes, including
electronic modes.
Dasti service of notice along with the copy of complaint and requisite
documents be also effected on the email, WhatsApp message(s), and text message of the
accused person(s) by the complainant and further subject to filing of a report of service
and all the screenshots along with an affidavit of service.
In case the accused does not appear, despite effective service of the
notice, it shall be deemed to have been served, and it shall further be presumed that the
proposed accused has knowledge of the same and that he does not want to be heard on
the issue of cognizance in the present lis. Consequently, instant matter will proceed in
his absence on the issue of cognizance.
