Present : Mr. Puneet Kumar, Ld. Counsel for the plaintiff
(
through Video Conferencing).
None for the defendant.
Ld. Counsel for the plaintiff stated that he does not
want to file replication. While perusing the file for
framing of issues, it is seen that verification clauses
of the plaint and written statement are not bearing
the date of verification of the pleadings. The
plaintiff and the defendant are given opportunity to
rectify the said defect within one week from today
after seeking leave of the Court. On examination of
the pleadings and documents, following issues are
framed:
(i) Whether the plaintiff has not affixed
ad valorem
Court Fees?
(OPD)
(ii) Whether the plaintiff is entitled to a decree for
recovery of Rs. 6,80,251/-, as prayed?
(OPP)
(iii) Whether the plaintiff is entitled to
pendente-
lite
and future interest @ 12% per annum?
(OPP)
(iv) Relief.
The plaintiff and the defendant shall file list of
witnesses within one week from today with advance
copy to Ld. Counsel for the opposite party. The
plaintiff is directed to file affidavits of the witnesses
within one week with advance copy,
at least three
days before the date of hearing, to Ld. Counsel for
the defendant.

The plaintiff is also directed to take steps for
summoning of any witness / record, on PF, subject
to actual expenses incurred by the witness, if any.
