Ld. Counsel for the plaintiff submits, on instructions, that the
plaintiff has already received Rs.1,34,000/- on 23.12.2025 in terms of
preliminary decree passed vide order dated 10.12.2025 in favour of the
plaintiff.
WS alongwith copy of screenshots showing payment of
Rs.1,34,000/- to the plaintiff filed on behalf of defendant. taken on record.
Copy already supplied.
Between dates of hearing, replication also filed by the plaintiff.
It is jointly submitted that parties do not wish to file affidavit of
A/D of documents.
Considering the submissions made, A/D of documents is
dispensed with.
Pleadings are complete in this case. Following issues arise out of
the pleadings—
1. Whether the plaintiff is entitled to a decree of recovery of
Rs.10,66,000/- (Rs.12 lakhs – Rs.1,34,000/-), as prayed for? OPP
2. Whether the plaintiff is entitled to interest, if yes, at what rate and for
what period? OPP
3. Relief

No other issue arises or is pressed for. List of witnesses be filed
by parties within 14 days. Evidence by way of affidavit be supplied atleast 10
days in advance to the other side.
Matter is now fixed for PE on 29.07.2026. Evidence by way of
affidavit be supplied atleast 10 days in advance to the other side.
