Replication along with affidavit of A/D of documents of the
defendant filed by the Plaintiff. Copy supplied.
No such affidavit of A/D of documents has been filed by
the Defendant till date.
I have perused the record.
Perusal of record shows that vide Order dated 06.06.2024,
parties were directed to file affidavit of A/D of documents of opposite
parties. Thereafter, again on 05.09.2024, same directions were passed.
On 25.11.2024, last and final opportunity was given to parties to file
such affidavit. Defendant has not filed such affidavit despite being
granted sufficient opportunities.
Ld. Counsel for Defendant seeks some more time to file
affidavit of A/D of documents filed by the Plaintiff.
Defendant is granted last opportunity to file such affidavit
subject to costs of Rs.10,000/- to be deposited with DLSA, Shahdara. It
is made clear that in case of non compliance, the defence of the
defendant shall be struck off.
Put up for compliance as above and for framing of issues
on 17.07.2025.
