Today, matter is listed for reply and arguments on application under order 7 rule 11 CPC and application under order 39 rule 1 and 2 CPC filed by D1 to D5 and application under Section 5 of Limitation Act and application under order 1 rule 10 CPC filed by D6. At this stage, Ld. Counsel for D1 to D5 submits that he does not wish to pursue the application under order 39 rule 1 and 2 CPC and wants to withdraw the same. Heard. In view thereof, the application under order 39 Rule 1 and 2 CPC is hereby disposed of as withdrawn. At this stage, Ld. Counsel for D1 to D5 has pressed the application under order 7 rule 11 CPC. Part arguments heard. Plaintiff is directed to file reply to the aforesaid application within four weeks with an advance copy to the opposite party, failing which cost of Rs. 5000/- shall be imposed. At this stage, Ld. Counsel for plaintiff fairly submits that he does not wish to file reply to the application under order 1 rule 10 CPC and application under Section 5 of Limitation Act filed by D6 and would argue the same -- 1 of 2 -- straightway. Heard. In view thereof, the right to file reply by plaintiff is hereby closed. Matter is adjourned. Matter be listed for further arguments on application under order 7 rule 11 CPC on 17.03.2026.
