Present: Ms. Jyoti Verma, Ld. Counsel for the plaintiff along with Sh.
Hans Kumar Jain, AR of the plaintiff.
Defendant in person.
The matter is fixed for talk of settlement, failing which for framing
of issues.
Today, AR of the plaintiff has told to the court that the defendant
has flatly refused to settle the matter.
Defendant is also present today in the court and he has told to the
court that he is no more desirous to settle the matter.
Since the pleadings of the parties have already been completed so
from the pleadings of the parties, following issues have been arisen and are being
framed:-
(1) Whether the plaintiff is entitled to recover an amount of Rs.
28,49,665/- from the defendant? OPP
(2) Whether the plaintiff is also entitle to recover any interest from
the defendant? if so, at what rate? OPD
(3) Whether the suit of the plaintiff is not maintainable? OPD
(4) Relief.
No other issue arises or pressed upon by any of the parties.
Both the parties are directed to file list of witnesses in the court
within 15 days from today and to exchange the copies thereof.
The matter stands adjourn for evidence of the plaintiff.
The plaintiff is directed to file affidavits of all the witnesses in the
court one week prior to the next date of hearing and to supply advance copies
thereof to the defendant or his counsel in similar fashion.
To come up on 04.09.2024.
