Sh. Himanshu, Proxy Counsel for defendant (through VC).
An application u/o VIII Rule 1 CPC seeking condonation of delay in
filing of WS by the defendant is pending for disposal.
Ld. counsel for the plaintiff submits that he has no objection if the
application is allowed and delay in filing of WS may be condoned subject to cost.
Arguments heard on the above application. Record perused.
For reasons stated in the application and also in view of no objection
given by ld. counsel for plaintiff, instant application of the defendant is disposed off
as allowed subject to cost of Rs.1,000/- to be paid to the plainitiff. Delay in filing the
WS stands condoned and WS filed by the defendant is taken on record.
Replication, if any, be filed within 04 weeks by the plaintiff with
advance copy to the other side.
Both the parties are directed to file affidavit of A/D of the documents
respectively filed by the other side with advance copy to the opposite party.
Put up for completion of pleadings, filing of affidavit of A/D of
documents and framing of issues on 17.12.2025.
