Present: Ms. Madhulika, Ld. Proxy counsel for the revisionists/accused.
The present revision petition is filed against the order passed
by Ld. MM dated 25.07.2024, vide which the NBWs issued against the
revisionist nos.2 & 3 herein, were stayed by the Ld. MM, subject to
payment of cost of Rs.2,000/- each to be deposited in DLSA.
It is submitted by Ld. Counsel for the revisionists / accused
persons that said cost has yet not been deposited, rather, the accused
persons / revisionist nos.2 & 3 have preferred the present revision petition.
Trial Court record received today.
Perusal of the order dated 25.07.2024 shows that despite the
presence of accused nos.2 & 3 (revisionist nos.2 & 3 herein), the Ld. MM
instead of either taking into custody the accused persons / revisionist nos. 2
& 3, or granting bail to them, stayed the NBWs, subject to cost of
Rs.2,000/- per accused / revisionist. This action of the Ld. MM is in
challenge before this Court in the present revision petition.
Accordingly, let notice of the present revision be issued to the
respondent nos.1 & 2 on filing of PF for 10.01.2025. Steps be taken in this
regard accordingly.
