Vide statement recorded under Section 294 Cr.P.C., accused
admitted the genuineness of documents Ex.A-1, Ex.A-2 and Ex.A-3. Accordingly,
witness mentioned at Sl. No. 6 Abdul Kadir stands dropped from the list of
witnesses.
It is stated by Ld. Counsel for complainant that complainant
Shabana is unwell and is unable to appear before the Court today. On being asked
about her availability tomorrow i.e. 10.07.2024 (date already fixed), Ld. Counsel
expressed the inability of witness to appear. He requested for adjournment for
15.07.2024. Objected to by Ld. Defence Counsel stating no medical document of
complainant is being produced today and she is deliberately delaying the trial as
she failed to appear even on 31.05.2024 despite service.
In the interest of justice, one opportunity is granted to complainant
Shabana. In order to ensure the presence of said witness, let the matter be fixed
for 15.07.2024. PW Shabana is directed to appear on the said date positively. Also
issue summons to PW Sarfaraz for date fixed. Accordingly, date fixed earlier i.e.
10.07.2024 stands canceled.
