STATE Vs. Junaid (IA-7-2025)
FIR No. 383/2024
u/s 307/102B/34 of IPC
PS Welcome
19.12.2025
Present: Sh. Pradeep Kumar, Ld. Addl. PP for the State.
Mr. Virendar and Mr. Mukesh, Ld. Counsel for the
applicant/accused.
This is an application for release of accused Junaid on personal bond
on the ground that accused is in JC. It is contended that the above said accused is
in JC since 14.06.2024 and granted regular bail vide order dt. 14.10.2025 on the
condition to furnish the bail bond with one surety of Rs. 30,000/- but the
applicant is not capable to furnish the surety as he is sole bread-earner of his
entire family and languishing in jail from long time. It is contended that the old
mother and his wife is a house wife and have no source of income. It is further
contended that the applicant is not in a position to furnish the surety for such
amount as he is a poor person.
Reply to this application has been filed as per which, an inquiry was
conducted at the last known address of the accused. There, the mother of the
accused was found to be residing in the house belonging to her real sister. The
mother of the accused stated that the accused was also residing with her.
Arguments have been heard. Material on record perused.
Submission considered.
Ld. Counsel for the applicant has argued that the applicant be
released on furnishing personal bond as he is a poor person who is unable to
furnish surety.

On the other hand, Ld. APP has opposed this application on the
ground that the applicant may flee from justice if released without surety.
This court finds that the applicant is in custody despite being granted
bail vide order dt. 14.10.2025. His address stands verified. Therefore, in order to
give meaning and effect to the bail order, it is directed that the accused be
released on his furnishing a personal bond of Rs. 30,000/-.
Application disposed of accordingly.
Copy of this order be sent to Jail Supt. concerned for information of
the accused and be given ‘dasti’ to Ld. Counsel for accused/applicant, as
requested.
