Plaintiff is present physically in the court.

Advocates for the defendant.
The Ld. Counsels for the defendant have filed the replies
to the application of the plaintiff u/o IX Rule 9 r/w Section 151 CPC
and the application u/o XI Rule 5 CPC, along with their vakalatnama
on 24.12.2024. Advance copies of the same had already been supplied
to the Ld. Counsels for the plaintiff.
The Ld. Counsel for the plaintiff has prayed for
withdrawal of his application u/o XI Rule 5 CPC (I.A. No.01/2025)
and has prayed that the documents which were filed by the plaintiff,
with this application, may be returned to the plaintiff.
In view of the submissions of the Ld. Counsel for the
plaintiff, the said application u/o XI Rule 5 CPC (I.A. No.01/2025) is
dismissed as withdrawn. The original documents attached with the
said application be returned to the plaintiff, after filing the certified
copies of the same on record. I.A. No.01/2025 is disposed off
accordingly.
Submissions of the Ld. Counsels for the parties are also
heard on the application of the plaintiff u/o IX Rule 9 r/w Section 151
CPC.
