Raju, Ld counsel for defendant no.1 and 3. Proposed defendant Mohd. Naushad is present. Arguments on application under Order 1 Rule 10 CPC heard. Ld counsel for plaintiff submits that in the WS, defendant no.1 and 2 have mentioned that in the ground floor of the suit property one Mohd. Naushad is staying and Mohd. Naushad is having the chain of documents of ground floor of suit property executed by plaintiff’s grandmother in favour of Mohd. Naushad. As plaintiff is owner of half portion of the suit property and he has sought partition of the same, therefore, proposed defendant Mohd. Naushad is a necessary party and prayed that application under Order 1 Rule 10 CPC be allowed. Same is not opposed by Ld counsel for defendant no.1 & 2. Proposed defendant Mohd. Naushad is also present in the court and he is not opposing the application. Heard. On submission made, application under Order 1 Rule 10 CPC is allowed. Plaintiff is directed to file amended memo of parties and plaint and to supply advance copy of the same to proposed defendant. Put up on 22.10.2026 for further proceedings.
