Reply to the application under Order VII Rule 14
r/w Section 151 CPC already filed on 06.06.2024 on behalf of
defendant.
During the course of arguments, Ld. Counsel for
defendant, on instructions submits that defendant has no
objection, if the application under Order VII Rule 14 r/w Section
151 CPC be allowed subject to costs.
By way of the present application, plaintiff wants to
file the certified copy of the petition under Section 14(1)(a) DRC
Act, filed by the petitioner against her tenant along with the site
plan filed in the said petition.
In view of the contentions made in the application,
no objection given by the Ld. Counsel for the defendant and
considering the fact that no prejudice would be caused to the
defendant, if the present application be allowed and certified
copy of the petition and site plan be taken on record and also
considering that defendant shall have the right to cross examine
the plaintiff witnesses on the aforesaid documents, therefore, the
present stands allowed subject to costs of Rs.2,000/- which is to
be paid to the defendant.

Costs of Rs.2,000/- paid by the plaintiff to the
defendant.
Certified copy of petition and site plan are taken on
record.
Application under Order VII Rule 14 R/W Section
151 CPC is accordingly disposed off.
