Sh. Deepak Vats, Ld. Proxy Counsel for accused Ashraf @ Bittu.
Both accused not produced from JC.
An application has been moved on behalf of accused Ashraf @
Bittu by Ld. Defence Counsel for directing the Ld. Magistrate concerned for
supplying the legible copy of photographs of crime spot, video and CCTV
footage of the case.
It is stated by Ld. Proxy Counsel that accused has neither
received the CCTV footage nor the photographs annexed to the chargehseet
nor the e-challan of the present case. It is stated that all the aforesaid
documents be provided to the accused.
In the opinion of this Court, the statutory duty to furnish
chargesheet alongwith the annexed documents rests upon the Ld. Metropolitan
Magistrate. Accordingly, present case file be sent back to the concerned Court
of Ld. CMM/MM for deciding the application moved on behalf of accused
Ashraf @ Bittu by Ld. Counsel.
Put up on 20.11.2023 before concerned Court through office of
Ld. Principal District & Sessions Judge, Shahdara.
