Present: Sh. Abbas Khan, ld. Counsel for plaintiff with plaintiff (through
VC).
Sh. Anubhav Sesodia, Proxy Counsel for defendant no. 1 with
defendant no. 1.
None for other defendants.
Perusal of record shows that WS alongwith vakalatnama (running
upto 25 pages) on behalf of defendant no. 1 was filed on LDOH.
Counsel for the plaintiff submits that he has not received copy of
the same.
Proxy counsel for defendant no. 1 ensures to supply the same
during the course of the day.
Replication, if any, be filed by the defendant to the WS of
defendant no. 1 within 04 weeks with advance copy to the other side.
Perusal of record further shows that defendant no. 3 to 5
appeared on 11.12.2024. However, they have not filed their WS till date.
Counsel for the plaintiff submits that defendant no. 3 to 5 are
supporting the case of the plaintiff. Let affidavits of defendant no. 3 to 5 to that
effect be filed on or before NDOH.
Perusal of record shows that defendant no. 2 is yet to be
served. Let summons be issued to defendant no. 2 on filing of PF/RC/SP,
returnable for NDOH. Steps be taken within 07 working days.
At this stage, both the parties state that there is a possibility of
settlement in the present case and they pray that matter be sent to mediation.

Accordingly, put up before Ld. Mediation incharge on 13.05.2025
at 02:00 PM and before this court for recording of settlement, if any, on
12.07.2025. In case mediation fails, matter be listed for service report of
defendant no. 2, completion of pleadings and further proceedings.
