Today matter is listed for reply and arguments on application under
Section 5 of Limitation Act seeking condonation of delay and an application under
Order IX Rule 4 read with Section 151 CPC.
During the course of hearing, learned counsel for defendant fairly
submits that inadvertently, he could not file the application seeking setting aside of
order dated 11.08.2025, whereby right to file WS was closed and therefore, seeks
liberty to move an appropriate application in that regard. Heard. He is at liberty to
proceed as per law.
Rejoinder to the WS along with reply to the application under
Section 5 of Limitation Act and reply to the application under Order IX Rule 4 read
with Section 151 CPC filed by plaintiff on 20.12.2025. Same be taken on record.
Copy already supplied.
At this stage, learned counsel for defendant fairly submits that
evidence affidavit of PW along with LOW has already been received. Heard.
At this stage, learned counsel for the parties jointly submits that they
want to explore the possibilities of settlement between the parties and therefore,
request to refer the matter to Mediation Center. Heard.
In view of the above submissions, present matter be sent to
Mediation Center, KKD Courts and parties and Ld. Counsels for parties to appear
before Mediation Center, KKD Courts for 16.03.2026 at 12.30 pm.
Matter be listed before this court for report on 11.06.2026.
