Present:- Sh. Abhishek Garg, Ld. Counsel for plaintiff.
Ms. Alice Kumari, stated to be proxy counsel for Sh. Nishant
Tyagi, Advocate for defendant.
No WS has been filed so far despite service on 05.04.2025.
At this stage, Ld. Proxy counsel for defendant submits that she
has been recently engaged in the matter and therefore, seeks some time
to file the WS. Heard.
Perusal of the record shows that on the LDOH, one counsel
Ms. Swati Sisodhiya had appeared on behalf of defendant and sought
time to file Vakalatnama, but the same has not been filed so far.
Today, Ms. Alice Kumari appeared and submitted that she is
representing the defendant and sought time to file the WS. However, no
MOA or Vakalatnama has been filed on record. In the absence of any
authority on record, the appearance of Ms. Alice Kumari cannot be
recognized.
It is matter of record that the defendant has not filed the WS
within the stipulated period. No plausible explanation or sufficient
reason has came on record qua non filing of WS within stipulated
period. It seems that defendant does not want to contest the present suit.
Therefore, his right to file WS is hereby closed.
Matter is adjourned.
