Present: Sh. Brijesh Kumar and Sh. Ashish, Ld. Counsels for
the Plaintiff with plaintiff.
Defendant in person.
This is an application filed on behalf of plaintiff for
withdrawing the present suit on the ground that the matter has
been settled between the plaintiff and defendant no. 1 out of
court.
It is submitted that defendants no. 2 & 3 have no
role to play in the present matter and plaintiff and defendant no. 1
have settled the present matter out of court vide settlement deed
dated 05.12.2025, pursuant to which it has been agreed that the
plaintiff shall not claim any rights in the suit property against the
defendant no.1 in any manner whatsoever, and that they have no
objection if the present suit may be disposed of as settled. The
said settlement deed is now Ex.P1.
Separate statement of plaintiff and defendant no. 1
are recorded in this regard.
In view of the above, compromise decree is passed
between the parties.
No order as to the costs.
Compromise decree sheet be prepared accordingly.
At request of Ld. Counsel for the plaintiff, entire
court fees be refunded to the plaintiff, as per section 16 of Court
Fees Act.
Date already fixed i.e. 13.04.2026 stands cancelled.

Application for withdrawing the suit/ early
hearing stands disposed of in above terms.
Pending applications also stands disposed of as
having become infructuous.
File be consigned to record room, after due
compliance.
