FIR No. 273/21
PS GTB Enclave
U/s 302/307/120B/201/147/
149/34 IPC & S. 25/27Arms Act
State Vs. Vicky and Anrs.
(Applicant/accused Sachin @
Moti Budhi)
14.09.2026
File taken up on the interim bail application of
applicant/accused Sachin.
Present : Sh. Parmod Kumar, Ld. Addl. PP for State.
Complainant with Ld. Counsel Sh. Ravinder Kumar.
Sh. Ashish Gill, Ld. Counsel for applicant/accused.
1. The present application has been filed on behalf of
applicant/accused Sachin seeking interim bail for a period
of one month in FIR No. 273/2021, PS GTB Enclave,
registered under Sections 302/307/120B/201/147/149/34
IPC & Sections 25/27 Arms Act. The ground urged is that
the applicant’s minor son, aged about 5 years, requires
admission in nursery class and the applicant’s presence is
necessary to complete the admission formalities. Reply of
IO has been filed. Copy supplied. Arguments heard.
2. Learned counsel for the applicant submits that the
applicant has been in judicial custody since 03.10.2021;
his wife and four minor children are dependent upon him.
It is urged that despite best efforts of the mother, the
admission of the younger son Master Akshit could not be

secured in any school due to absence of the father, who is
required to complete the admission formalities. Hence,
interim bail for four weeks is prayed.
3. Per contra, the application is strongly opposed by
learned Addl. PP assisted by counsel for the family of
deceased. It is submitted that the applicant, along with
other accused persons, is persistently extending threats
through his family members to the victim side. It is further
pointed out that no particulars of any school have been
disclosed in the application where the child is proposed to
be admitted. It is thus prayed that the application be
dismissed.
4. Arguments considered. As per the reply of IO, the
applicant has four minor children who are residing with
their mother and grandmother. It is further reported that the
applicant’s wife is working and is capable of looking after
the children. The trial of the case is presently pending at
the stage of prosecution evidence before this Court.
5. The ground urged for interim bail is the admission
of the minor child in school. However, the application does
not disclose the name of the school, nor any documentary
particulars of admission process have been placed on
record. It is also not explained as to why the mother of the
child, who is admittedly present and working, cannot
complete the admission formalities. The plea appears
vague and unsupported by material particulars. On the
other hand, the allegations against the applicant are grave,

involving offences under Sections 302/307 IPC etc.
In
these circumstances, this Court finds no sufficient ground
to admit the applicant on interim bail. The application is
accordingly dismissed.
Nothing stated herein above shall tantamount to the
expression of opinion on merits of the case.
