Counsel for the plaintiffs. Sh. Ved Pal Singh (through VC) and Ms. Janhvi Titoria, Ld. Counsels for the defendants no.2 to 5. Arguments heard on the application U/o 39 Rule 1 and 2 CPC from both the sides. It is submitted by Ld. Counsel for plaintiffs that defendants no.2 to 4 are raising construction in the property bearing No.6/155, measuring 58 sq. yards, situated at Mohalla Lodhi Rajput, Farsh Bazar, Shahdara, Delhi - 32 and the suit property is a joint property in which the parties have 1/7th share each therein. Defendant no.4 is present today who submits that at present, there is one shop and two floors already constructed in the suit property and he is only repairing the terrace and is not carrying out any further construction in the said property, nor he has any intention to create any third party interest in the suit property. It is further submitted by Ld. Counsel for plaintiffs that plaintiff no.1 is in possession of the shop bearing no. 6/171, situated at Mohalla Lodhi Rajput, Farsh Bazar, Shahdara, Delhi - 32 and he alongwith other plaintiffs also has no intention to create any third party interest in the said shop. In view of the above, both the parties are directed to maintain status-quo w.r.t. title and possession qua both the suit properties as stated above, till the disposal of the present suit.
