An application under Section 151 CPC along with
fresh memo of parties filed on 30.08.2025.
Considering that defendant has been duly served on
his fresh address, therefore, application stands disposed of being
satisfied. Amended memo of parties is taken on record.
Application under Section 151 CPC is accordingly
disposed of.
Ld. counsel for defendant submits that defendant has
not received the copy of paper book along with the summons.
Copy of paper book supplied from the record to the
Ld. counsel for defendant.
Defendant is directed to file WS and affidavit of
admission and denial of documents within 30 days from today
with an advance copy to plaintiff.

Upon receipt of WS and affidavit of admission and
denial of documents, plaintiff is at liberty to file replication, if
any and affidavit of admission and denial of documents, if
required within 15 days thereafter with an advance copy to
defendant.
Parties are directed to produce original documents
on NDOH. Parties are also directed to file proposed issues, if any.
Parties are also directed to appear in person on
NDOH for the purpose of admission and denial of documents
and recording of their statements under Order X CPC, if
required.
Put up for completion of pleadings, admission and
denial of documents and framing of issues on 02.03.2026.
