Present : Sh. Naman Gari, Ld. Counsel for the plaintiff alongwith plaintiff.
The matter is fixed for personal appearance of the plaintiff and also for
consideration on the application u/o 5 Rule 20 r/w section 151 of CPC. Today, the
plaintiff has appeared alongwith his counsel and the Ld. Counsel for the plaintiff has
filed an application u/s 151 of CPC for filing of fresh address of the defendant alongwith
amended memo of the parties, one pen-drive and photocopy of Aadhar Card Sh. Manu
Khetrapal and submitted that Sh. Manu Khetrapal is the husband of the defendant. He
has further submitted that in view of filing this application today, the application u/o 5
Rule 20 r/w section 151 of CPC may be allowed to be withdrawn.
In view of the statement of the Ld. Counsel for the plaintiff recorded today
in the court. The application u/o 5 Rule 20 r/w section 151 of CPC filed by the plaintiff in
this court on dated 26.04.2025 is dismissed as withdrawn and the application filed today
u/s 151 of CPC, vide which, the fresh address of the defendant is sought to be filed is
allowed. Accordingly, fresh summons are ordered to be issued to the defendant on the
address as mentioned in the amended memo of the parties filed today in the court,
through all modes on taking the steps by the plaintiff within seven from today with the
direction to the defendant to file written statement, statement of truth and affidavit of
admission of denial within 30 days from the date of her service of summons. The
summons to be issued to the defendant are returnable on 05.06.2025.
