Order Details: COPY OF JUDICIAL PROCEEDINGS
Pdf Text: 2 CS (COMM) 554/24
Gaurav Gupta Vs. Khetrapal Kiran, proprietor of M/s Dynamic
Print Grafix
30.04.2025
Present : Sh. Naman Gari, Ld counsel for plaintiff.
Earlier the matter was fixed for 26.04.2025 for filing of the fresh address of
the defendant on dated 26.04.2025 and also for filing the receipt of the cost of Rs.500/-
which was ordered to be deposited in the account of DLSA Shahdara. On the last date of
hearing, one advocate had filed the hard copy of the application U/o V Rule 20 CPC r/w
Section 151 CPC along with one screenshot regarding the deposition of the cost and when
the Reader posted in this court was verifying the filing of the said application on e-portal
then the said advocate had left the court and thereafter despite repeated calls, he did not
appear in the court, so the matter was fixed for today for consideration on the said
application.
Today Sh. Naman Gari, advocate had appeared on behalf of the plaintiff to
argue on the said application filed U/o V Rule 20 CPC r/w Section 151 CPC. Plaintiff did
not appear. The perusal of the record reveals that even at the pre-institution stage, the
plaintiff did not furnish the fresh address of the defendant so non-starter report was issued.
Ld counsel for plaintiff has submitted that the plaintiff used to supply the goods to the other
parties which are named in the e-way bills but the plaintiff has failed to show that he had
made any sincere effort to find the fresh address of the defendant as even from the said
parties as named in the e-way bills, the plaintiff could inquire about the address of the
defendant and also could file the same in the court but the plaintiff did not make sincere
efforts. Plaintiff also did not appear in the court, so this application filed by the counsel for
plaintiff U/o V Rule 20 CPC is kept in abeyance till the next date of hearing. Matter stands
adjourned for personal appearance of plaintiff and also for consideration on the application
U/o V Rule 20 CPC r/w Section 151 CPC, to come upon 08.05.2025.
