The matter is fixed for filing of fresh address of the defendant and also
for service of summons to the defendant. But the plaintiff has failed to file the fresh
address of the defendant and also failed to take steps for serivce of summons to the
defendant. Today at the time of first call, proxy counsel for the plaintiff has appeared
through VC and sought passing over the matter. But, thereafter no one has appeared
on behalf of the plaintiff.
At this stage, Sh. Kusharg Bansal, Ld. Counsel for the plaintiff has
appeared through VC and again seeks passing over the matter as the plaintiff is
desirous to file an application u/o 5 Rule 20 r/w section 151 of CPC. Since, the
plaintiff has failed to file fresh address of the defendant and also failed to take steps
for service of summons to the defendant and Ld. Counsel for the plaintiff again seeks
passing over the matter. No ground is made out to further pass over the matter as the
board of this court is heavy. In the interest of justice, another opportunity is granted to
the plaintiff for filing fresh address of the defendant but subject to cost of Rs.500/- to
be deposited in the account of DLSA Shahdara within one week from today.
