Gaurav Gupta Vs. Khetrapal Kiran, proprietor of M/s Dynamic
Print Grafix
15.01.2026
Present: Sh. Naman Gari, Ld. Counsel for the plaintiff
None for the defendant.
On the last date of hearing i.e. on dated 18.12.2025,
I was on leave for half day and the Ld. Counsel for the Plaintiff
had filed an application u/o 5 rule 20 r/w section 151 of CPC.
The reader posted in this court had fixed the matter for today.
Today on calling the case, the Ld. Counsel for the Plaintiff has
appeared and submitted that the plaintiff does not have any other
address of the defendant and submitted that the defendant could
not be served on both the addresses placed on record by the
plaintiff and submitted that the defendant may be ordered to be
served on both the addresses, by way of publication of summons
in the newspapers ‘Amar Ujala’ and ‘Times of India’ having
circulation in the area of Delhi and Greater Noida.
Having heard to the Ld. Counsel for the Plaintiff,
this court has perused the record, since the perusal of the record
reveals that earlier the plaintiff had filed the address of
Patparganj, Delhi of the defendant at the time of filing of the suit,
thereafter, another address of defendant of Greater Noida was
also filed, but, the defendant could not be served on both the
addresses, so, at this stage, this court is also of the considered
opinion that the defendant cannot be served through ordinary
mode of service. Therefore, the defendant is ordered to be served
on both the addresses available on the record by way of
publication of summons in the newspapers ‘Amar Ujala’ and
‘Times of India’ having circulation in the area of delhi and also in
-- 1 of 2 --
the area of Greater Noida, on taking of steps by the plaintiff
within 7 days from today. In the abovesaid terms, application u/o
5 rule 20 r/w section 151 of CPC stands disposed off. The
summons to be issued to the defendant by way of publications of
summons thereof in the abovesaid newspapers are returnable on
dated 19.03.2026. Dasti summons are also ordered to be given to
the plaintiff/ his counsel.
