Present: Sh. Naman Gari and Ms. Ishika and ,Ld. Counsel for
the plaintiff.
None for the defendant.
The Matter is fixed for service of summons to the
defendant. Summons sent to the defendant are not received back.
Today, on calling of the case, no one has appeared on behalf of the
defendant. Only the counsels for plaintiff have appeared and Ld.
Counsel for the plaintiff has filed affidavit of his clerk alongwith
postal receipt, courier receipt and track record regarding the non
serving of summons to the defendant through all modes and also
through dasti. The counsel for the plaintiff has submitted that since the
summons to the defendant could not be served even on the address, as
mentioned on the Aadhar Card of Sh. Manu Khetrapal who is the
husband of the defendant and submitted that the plaintiff does not have
any other address of defendant and seeks passing over of the matter for
filing application u/o 5 Rule 20 CPC but, as the board of this court is
heavy so no ground is made out to passover the matter. Matter stands
adjourned for filing of filing such application under Order 5 Rule 20 of
CPC by plaintiff.
