TCR received. File perused. Submissions heard on
the application moved under Section 24 r/w Section 151 by the
applicant, seeking transfer of the case bearing RC ARC
No.131/2024, titled as “Prakhar Dogra Vs. Manoj Kumar Gupta”
pending in the court of Ms. Saloni Singh, Ld. SCJ, Shahdara
District, KKD Courts, Delhi, to the court of Sh. Gaurav Sharma,
Ld. ACJ/ARC/CCJ, Shahdara District, KKD Courts, Delhi where
the connected matter bearing RC ARC No.134/2024, titled as
“Pranav Dogra Vs. Hemant Khanna” is pending. It is stated that
since both the matters pertain to the same property and title
documents and since learned judge Ms. Saloni Singh, Ld. SCJ
has been transferred and no new judge has joined in the said
court and summons have yet not been issued in the matter,
therefore the case bearing RC ARC No.131/2024 be transferred
to the court of Sh. Gaurav Sharma, Ld. ACJ/ARC/CCJ, Shahdara
District, KKD Courts, Delhi.
In the case filed by the plaintiffs/applicant, which
was assigned to the court of Ms. Saloni Singh, Ld. SCJ, Shahdara
District, KKD Courts, Delhi, who is under transfer, the
defendants have not been summoned. Since the defendants have
not been summoned in the case till date and since the case is
freshly instituted and since the concerned court is vacant and no

new judge has been appointed, no notice is required to be issued
to the non applicants of this transfer application. Accordingly, in
the given facts, the case bearing RC ARC No.131/2024, titled as
“Prakhar Dogra Vs. Manoj Kumar Gupta” pending in the court of
Ms. Saloni Singh, Ld. SCJ, Shahdara District, KKD Courts,
Delhi (vacant court), is withdrawn from the said court and is
transferred to the court of Sh. Gaurav Sharma, Ld.
ACJ/ARC/CCJ, Shahdara District, KKD Courts, Delhi, to be
tried as per law with the connected matter bearing RC ARC
No.134/2024.
Applicant/plaintiff to appear before the Ld.
Transferee Court on 24.10.2024. Transfer application stands
disposed of as allowed. TCR be returned to the concerned court
alongwith copy of the order for compliance.
Miscellaneous file be consigned to record room.
