None for the defendants.
Matter is at the stage of arguments on the application
U/o 7 Rule 11 CPC.
Today, no one has appeared on behalf of defendants
despite several calls.
In the interest of justice, last and final opportunity is
given to the defendants to address arguments on the application,
failing which the present application shall be dismissed for non-
prosecution.
Ld. Counsel for plaintiff has also submitted that he has
filed an application U/o 39 Rule 1 and 2 CPC w.r.t. shop bearing
no.1157-A/1, Private Shop No.5, measuring 8.3 sq. meters, main
Babarpur Road, West Rohtash Nagar, Shahdara, Delhi – 32, on the
ground that the defendants have not paid any sale consideration to the
plaintiff pursuant to the sale deed dated 14.10.2021 and they are trying
to dispose of the said shop for the purpose of defeating the rights of
the plaintiff in the present suit.
In view of the above, the defendants are directed not to
create any third party interest qua the shop bearing no.1157-A/1,
Private Shop No.5, measuring 8.3 sq. meters, main Babarpur Road,
West Rohtash Nagar, Shahdara, Delhi – 32, till NDOH.
Put up for arguments on the application U/o 7 Rule 11
CPC as well as application U/o 39 Rule 1 and 2 CPC on 28.05.2026.
