Pleadings are complete. On the basis of pleadings of
parties, following issues are framed:-
i) Whether plaintiffs are entitled to relief of declaration
thereby declaring the GPA, Agreement and Receipt
all dated 22.10.1973 and Will dated 20.04.2015 as
null and void ? OPP.
ii) Whether plaintiffs are entitled tofurther relief of
declaration thereby declaring the plaintiffs as owners
of 50% share in the suit property as claimed ? OPP
iii) Whether plaintiffs are entitled to relief of possession
qua the suit property as claimed ? OPP
iv) Whether plaintiffs are entitled to relief of Permanent
and mandatory injunction as prayed ? OPP
v) Whether the present suit is barred by the provisions of
limitation? OPD.
vi) Relief.
No other issue arises or pressed for. Both the parties
are directed to file list of witnesses within 15 days from today
with advance copy to opposite party. Plaintiffs are directed to
supply the advance copy of evidence by way of affidavit of its
witnesses to defendants at least one week before NDOH.
