NEERAJ AND ORS Vs. THE STATE ANR
PS (Harsh Vihar)
27.01.2026
Present: Mr. Arpit Choudhary, Ld. Counsel for revisionist along with
revisionist no. 01, 02, 3 and 05 (Fresh Vakalatnama filed. Taken on
record).
Mr. Manmohan Satija, Ld. Counsel for the R-2 along with R-2.
Sh. Pradeep Kumar, Ld. Addl. PP for the State.
Application for condonation of delay in filing of the revision petition
is pending on the ground that the certified copy of the impugned dt. 10.04.2024
was misplaced by the previous counsel for the revisionist and was traced after
considerable time. Revision petition is stated to have been filed on 07.10.2024.
Arguments have been heard. Material on record perused. Submission
considered.
Ld. Counsel for R-2 submits that R-2 has no objection in case the
delay is condoned in the interest of justice so that the matter can be heard on
merits. However, he prays that appropriate cost be imposed upon the revisionists.
In view of the aforesaid, delay stands condoned subject to cost of
Rs. 500/- per revisionist to be paid to R-2 by the NDOH.
Considering that the matter has an element of settlement, matter is
referred to Mediation Centre, KKD for 03.02.2026 at 02:00 PM, the revisionists
and respondent no.-2 shall appear in person before the Mediation Centre and
before the Court settlement/arguments on 17.03.2026.
TCR be sent back and be summoned afresh for NDOH.
