discharged now as fresh Vakaltnama has been filed on behalf of
accused S Gopi Nath.
PW S K Raji present for evidence since morning,
but discharged unexamined as Ld. Addl. PP has been posted in
two courts and he has gone for additional duty in another Court.
The presence of Addl. PP is important in this case as this is a
murder case. In many cases the witnesses are being discharged
unexamined and today also this lady witness, who is a
Government servant, is discharged unexamined despite waiting
since morning. Trial in many cases have been halted due to
posting of Ld. Addl. PP in two courts and this Court has written
twice to the Director of Prosecution for posting of some other
Prosecutor in the Court of Sh. Ashish Rastogi, Ld. ASJ,
Electricity, East District, KKD Courts as it is not possible to run
such a heavy Court without the full services of Ld. Addl. PP as
the Court apart from trial also needs the assistance of Ld. Addl.
PP in the Revisions and Appeals in which State is made a party
and also during the hearing of bail applications pertaining to trial

files and bail roaster. Despite writing twice, no action has been
taken by the Director of Prosecution.
Copy of this order be sent to Secretary Home for
further direction in this regard otherwise this Court shall impose
cost on the Prosecution for sending witnesses back unexamined
every day due to non-availability of Ld. Addl. PP.
Let PW S K Raji and ACP Mahesh Kumar
(mentioned in the list of witnesses at Sl. No. 1 and 18
respectively) be also summoned through SHO concerned for the
next date.
IO and MHC(M) with case property be also
summoned through SHO concerned for the next date.
Put up for PE on 26.11.2024.
Copy of this order be also sent to Director of
Prosecution.
