No steps taken with respect to service of defendant
no.4.
Let WS be filed on behalf of defendant no.2 and 4, if
any, within stipulated period with advance copy to the plaintiff.
Arguments heard on application U/o 39 Rule 1 and 2
CPC from both the sides.
It is submitted by plaintiff that plaintiff is in
possession of first floor of the suit property and the defendant
no.1 is in possession of ground, second and third floor of the suit
property.
Counsel for defendant no.1 submits that defendant
no.1 has no intention to create any third party interest in the suit
property.
Accordingly, the application U/o 39 Rule 1 and 2
CPC filed by the plaintiff is allowed thereby directing both the
parties to maintain status-quo with respect to the possession and
title of suit property till the disposal of the present suit.
Put up for completion of pleadings/ framing of
issues on 11.09.2024.
