counsels for defendant.
Today, matter is listed for clarification in terms of
order dated 28.08.2025 as well as reply and arguments on
application under order 7 rule 14 CPC filed by defendant.
Ld. Counsel for defendant submits that he does not
wish to pursue the application under order 7 rule 14 CPC and
wants to withdraw the same as the same has not been filed
under the correct provisions of law with liberty to file it
afresh. Heard.
In view of the above submissions, the aforesaid
application is disposed of as withdrawn with liberty to file it
afresh in accordance with law.
Ld. Counsel for plaintiff seeks adjournment on the
ground that she has been engaged recently and needs time to
go through the file. Same is opposed. Heard.
Last opportunity is granted to the plaintiff to give
clarification on NDOH, failing which matter shall proceed in
accordance with law. It is made clear that no further
opportunity shall be granted for the said purpose.
Matter is adjourned.
Matter be listed for clarification on 11.06.2026.
NDOH is given as per convenience of the Ld. Counsels for the
parties.
