Present: Ms. Alka Gaur, Ld. Counsel for DH.
Submissions heard. Nazir Report perused. Perusal of Nazir
report shows that JD No. 2 is residing at Jharkhand. However, perusal of
case file shows that that there is only one JD and he is resident of Dumka,
Bhagalpur Road, Jharkhand. Evidently, Nazir has submitted incorrect
report which per-se shows that he is not diligent for performing his duty.
Issue Show cause Notice to Nazir of this Court and he is directed to file
reply within three working days as to why as to why it shall not be treated as
as a dereliction of duty & mis-conduct and as to why Departmental
proceedings/Enquiry not be initiated against him. In so far as this petition
seeks execution of judgment and decree dated 30.11.2023 passed by this
Court, record reveals that address of JD is Dumka, Bhagalpur Road,
Jharkhand. Ld. Counsel for DH has prayed that Transfer Certificate may be
issued. As such, as prayed, let Transfer Certificate be issued as per rules.
File be consigned to Record Room after due compliance.
