On the basis of pleadings, following issues are framed: - (i). Whether petitioner got injured in a motor vehicular accident occurred on 10.04.2024 at 12.00 p.m. near Raddison Hotel, Red light, Noida Sector- 58, U.P. , within jurisdiction of PS Noida Sector-58, due to rash and negligent driving of offending vehicle i.e. bearing registration No.UP-16ET-6319 driven by respondent no. 1 Mujahid Hussain (driver)? (OPP). (ii). Whether the petitioner is entitled to compensation on account of said accident and if yes, to what extent and from whom? (OPP). (iii) Relief. List of witnesses be filed by the petitioner within two weeks from today. The evidence by way of affidavit of the petitioner is not in accordance with law. Let fresh affidavit of the petitioner be filed in compliance of Rule 8 (2) (b) of Delhi MACT Rules, -- 1 of 2 -- -2- 2008 and advance copy of same be supplied to Ld. counsel for respondents at least one week before NDOH.
