YOGENDER NATH SHARMA
Vs.
STATE
14.01.2025
Present: Sh. Narveer Dabas, Ld. Counsel for the appellant.
Sh. Jitendra Sharma, Ld. Substt. Addl. PP for the State/R1.
Sh. Sandeep Kumar, Ld. Counsel for remaining respondents.
The matter is listed for judgment.
Arguments in the matter were heard on 05.12.2024 &
10.12.2024, as mentioned in detail in order-sheet dated 10.12.2024 (four
pages).
After that, the matter was reserved for judgment. The judgment
could not be passed on 20.12.2024 and matter was adjournment for
judgment for today.
Post the last date of hearing, one of the parties tried to
approach the undersigned. Though, the said fact by itself has no impact on
the impartiality of the undersigned to decide the case on merits, but
propriety demands that this fact be brought to the notice of parties and the
matter be placed for consideration before Ld. Principal District & Sessions
Judge to either transfer the matter to some other Court or to reassign the
matter to this Court for disposal, as deemed fit by Ld. Principal District &
Sessions Judge. In my opinion, by doing so, a clear message would go to
everyone that the Court exhibit the highest standard of propriety as
demanded by Chapter 4 of Banglore Principles of Judicial Conduct, which
deals with value of propriety.
Accordingly, let the matter be placed before Ld. Principal
District & Sessions Judge, Shahdara District, KKD Courts, on 16.01.2025
for appropriate orders. Parties to appear before the Court of Ld. Ld.
Principal District & Sessions Judge, Shahdara, on the said date.
