During the course of arguments, Ld. Counsel for
plaintiff on instructions submits that plaintiff wants to withdraw
the application under Order XII Rule 6 r/w Section 151 CPC.
In view of the submissions, the present application
under Order XII Rule 6 r/w Section 151 CPC is hereby dismissed
as withdrawn and accordingly disposed off.
PW Ankit Uttam is present. He has been examined
as PW2. Ld. Proxy Counsel submits that main Counsel is not
available today to cross examine PW2 as he is busy in another
matter in Tis Hazari Courts. On the request of Ld. Proxy
Counsel, cross examination of PW2 is deferred subject to the cost
of Rs.1,000/- which is to be paid by LRs of defendant to the
witness on or before the next date of hearing.
