Respondent no.2, namely, Kenneth Angelo Dias has
been served summons by way of publication in newspaper ‘Veer
Arjun’ dated 17.10.2024. It is hereby declared that respondent
no.2 has been duly served with the notice. As none on behalf of
respondent no.2 has appeared, therefore, respondent no.2 is
hereby proceeded exparte. Pleadings are complete.
On the basis of pleadings, following issues are
framed: -
(i). Whether Sh. Aakash Kaushal died in a motor
vehicular accident occurred on the night of 27/28.02.2023
at about 03.30 a.m. near Chowk Kotwan, Delhi-Agra
Highway, Dist. Mathura, U.P. within jurisdiction of PS
Kosikalan, due to rash and negligent driving of offending
vehicle i.e. car bearing registration No.GA-06E-1980
driven by respondent no. 1 Sh. Yasin (driver)? (OPP).
(ii). Whether the petitioners are entitled to compensation
on account of said accident and if yes, to what extent and
from whom? (OPP).
(iii) Relief.
List of witnesses be filed by the parties within two
weeks from today. Advance copy of evidence by way of affidavit

be filed by the petitioners as well as be supplied to the
respondents at least 7 days before NDOH.
Put up for PE before the Tribunal on 03.03.2025.
