Present: Ms. Meenu, Ld. proxy Counsel for plaintiff.
Defendants are yet to be served.
An application under Order XXII Rule 4 CPC has been
filed on behalf of plaintiff.
Perusal of the record shows that late Sh. Sita Ram, late
Sh. Babu Lal Chaudhary, late Smt. Shanti Devi and late Sh. Bhawani
Singh are not party to the present suit, therefore, the said persons
cannot be substituted.
Ld. Proxy counsel for plaintiff, on instructions submits
that she be allowed to withdraw the present application with the
liberty to file an appropriate application under Order I Rule 10 CPC
for impleadment of LRs of Late Sh. Ganpat.
In view of the submissions, present application is hereby
dismissed as withdrawn with the liberty to file an appropriate
application under Order I Rule 10 CPC for impleadment of LRs of late
Sh. Ganpat.
Application under Order XXII Rule 4 CPC is
accordingly disposed of.
Proposed amended memo of parties filed.
Ld. Proxy counsel for plaintiff submits that she will file
another amended memo of parties. Let the same be filed.
