Present: Sh. V.P. Tiwari, Ld. counsel for plaintiff.
The matter is fixed for removal of the objection and also
consideration of the plaint. In the meantime, on dated 29.09.2026, the
Ld. counsel for plaintiff had filed an application under section 151 of
CPC. The Ahlmad of this court was directed to verify the filing thereof
on the e-portal and put up the same with the file on the date already
fixed i.e. today. Assistant Ahlmad posted in this court has verified the
filing thereof on the e-portal of the court and also reported that this
application under section 151 of CPC has been filed without court
fees.
Today on calling the case, Ld. counsel for plaintiff has
appeared in the court. He is apprised about the fact of non-affixing of
court fees on this application. Whereon, the Ld. counsel for plaintiff
has sought permission to affix the court fees thereon. Accordingly, Ld.
counsel for plaintiff is allowed to affix the court fees thereon and Ld.
counsel for plaintiff has affixed the court fees of Rs. 6/- thereon.
Thereafter, the Ld. counsel for plaintiff has sought permission to
withdraw this application under section 151 of CPC filed in the court
on 29.09.2026, in view of some clerical mistakes therein, as the
plaintiff is desirous to file afresh similar application after rectification
therein.
In view of the statement of Ld. counsel for plaintiff,
recorded today in the court, the said application filed by the Ld.
counsel for plaintiff under section 151 of CPC is dismissed as
withdrawn.

At this stage, Ld. counsel for plaintiff seeks adjournment
for 07.10.2026 for filing the same. Accordingly, matter stands
adjourned for the same purpose. To come up on 07.10.2026.
