statement of truth, affidavit of admission/denial by the defendant.
But, the defendants have failed to file the same. Today, Ld. proxy
Counsel for the defendants has appeared and seeks passing over the
matter as neither defendants nor main counsel of the defendants
have come in the court.

The Ld. Counsel for the defendants has filed the
vakalatnama on behalf of the defendants. Same is taken on reocrd.
Matter is fixed for filing written statement, statement of
truth and admission/denial by the defendants. The matter was
passed over for 12:00 noon but, the matter could not be taken up at
12:00 noon as this court remained busy in examining the witness in
pre lunch session. Matter is taken at 02:20 PM and on calling the
case, Ld. Counsels for the parties have appeared. ld. Counsels for
the defendants seek adjournment as the defendants could not come
in view Chhat Puja. Ld. Counsel for the plaintiff has submitted that
since the defendants failed to file the written statement, statement
of truth, affidavit of admission/denial within 30 days even from
supplying the copies of all the documents by him to the Ld.
Counsels for the defendants, so, their right to file the written

statement, statement of truth, affidavit of admission/denial may be
closed.
In view of the request made by the Ld. Counsel for the
defendants and in the interest of justice, last and final opportunity is
granted to the defendants to file written statement, statement of truth
and affidavit of admission/denial subject to cost of Rs. 3000/- to be
given to the plaintiff on the next date of hearing.
To come up on 13.11.2024 at 12 Noon.
