Present: Sh. Sundar Lal, Ld. Counsel for the plaintiff.
Sh. Rakshit Singh along with Sh. Vimal, Ld.
Counsels for the defendant.
The matter is fixed filing of replication, case
management and framing of issues. Today, Ld. Counsel for the
plaintiff has filed the replication. Copy thereof has been supplied to
the Ld. Counsel for the defendant. But filing of the replication could
not be verified on the e-portal of the court by the Ahlmad of this
court as server is not working.
Out of the pleadings of the parties, following issues
have been arisen and are being framed:-
(1) Whether the plaintiff is entitled to recover an
amount of Rs. 30,17,700/- from the defendants? OPP
(2) Whether the plaintiff is also entitle to recover any
interest from the defendants? if so, at what rate?OPP
(3) Whether the suit of the plaintiff is not maintainable?
OPD
(4) Whether the defective Chemicals and Synthetic
cloth supplied by the plaintiff through her proprietorship concern
and through firm of her husband? OPD
(5)Relief.
No other issue arises or pressed upon by any of the
counsels for parties.

Both the parties are directed to file list of witnesses in
the court within 15 days from today and to exchange the copies
thereof with the opposite party.
The matter stands adjourned for evidence of the
plaintiff.
Plaintiff is directed to file affidavits of all the witnesses
in the court one week prior to the next date of hearing and to supply
advance copies thereof to the defendant or his counsel in similar
fashion.
