plaintiff.
Sh. R.B. Singh Ld. Counsel for D-1 with D-1 (Fresh
v/nama filed. Same be taken on record.).
D-1 in person.
Sh. Pulkit Luthra Ld. Counsel for proposed
defendant.
None for D2 to D4.
Perusal of record shows that steps not taken by the
plaintiff in compliance of order dt. 05.10.2024 qua the service
of D2 and D3.
Plaintiff is again directed to provide fresh and correct
address of D2 and D3 within 10 working days from today,
subsequent to which notice be issued to D2 and D3 on PF/RC,
returnable for NDOH. PF be filed within a week from today.
Perusal of record shows that D-4 has been served
through D-1 on 13.08.2024 and vide order dated 05.10.2024,
D1 was directed to bring the D-4 before the court for today.
However, at this stage, D-1 submits that he is not in contact
with D-4 and cannot bring her. Heard.
Since, the D-4 has been served through D1,
therefore, it cannot deemed to be proper service. Accordingly,
issue fresh summons of the suit and notice of the application
to D-4 on filing of PF/RC, returnable for NDOH.
At this stage, Ld. Counsel for D-1 seeks adjournment
on the ground that he has been engaged today only and needs

some time to go through the file. Heard.
At the request of Ld. Counsel for D-1, matter is
adjourned.
Matter be listed for appearance of D 2 to D4, reply
and arguments on the application u/o 1 R 10 (2) CPC filed by
applicant Sonu Thareja for 07.12.2024.
