Revisionist has filed the present revision along with
application u/s 5 Limitation Act for condonation of delay of 70 days.
Ld. Counsel for revisionist submits that there is delay of
68 days and argued that exemption for obtaining certified copy may be
granted, but he has not made any averment in this regard in his
application.
He may file amended application for limitation with the
requisite affidavit of the revisionist.
During the course of argument, it is submitted by the
revisionist that she had filed a complaint against the respondents
before SHO, Shahdara, but not before DCP concerned.
Ld. Counsel for revisionist submits that he has not gone
through the judgment of
Priyanka Srivastava Vs. State of UP 2015
SCC. He submits that he will go through the same and submit before
the Court regarding the maintainability of his application u/s 156(3)
Cr.P.C. as well as present revision in the absence of any specific
complaint against the accused before DCP concerned as required u/s
154(3) Cr.P.C.
