Amended application u/s 5 of the Limitation Act for
condonation of delay filed on behalf of revisionist.
Arguments heard on behalf of both parties.
One more application has been filed for waiving the
cost of Rs. 5,000/- imposed on 25.09.2025. It is submitted that
revisionist could not appear on that day, he was suffering from
loose motion. The reason mentioned appears to be an
afterthought as neither counsel was present to argue on
maintainability nor said amended application for limitation was
filed nor counsel for revisionist or revisionist appeared through
VC or physically. Considering the same, application for waiving
cost is dismissed.
It is submitted by Ld. Counsel for revisionist that he
will pay cost of Rs. 5,000/- today itself and produce the receipt of
the same on the next date.
Put up for consideration on application u/s 5 of
Limitation Act as well as arguments on behalf of State on
22.01.2026.
