Present: Sh. Pankaj Garg, Ld. counsel for plaintiff through
VC.
Defendant is yet to be served.
It is stated in the application that defendant is still
residing in the same address mentioned in the memo of parties
and he is deliberately avoiding the service of summons. It is
further stated that plaintiff does not have any other address of
defendant, therefore, the present application is being filed for
effecting service of summons by substituted mode.
File perused.
In view of the contentions made in the application
let fresh summons in the present suit as well as notice of the
application under Order XXXIX Rule 1 and 2 CPC be issued
upon defendant on filing of PF/RC, returnable for NDOH.
In case of refusal/non-availability/lock, service be
effected by affixation. Photographs be also taken and filed on
record.
Dasti summons be also issued.
PF be filed within 03 days from today.
Application under Order V Rule 20 r/w Section 151
CPC is accordingly disposed of.
