Today, this matter is fixed for consideration.
TCR has been received.
An application u/s 389 Cr. P.C. for suspension of
sentence as well as for grant of bail till the pendency of appeal has
also been filed along with appeal by the appellant.
Heard. In view of the submissions made as well as in
the light of facts and circumstances, execution of sentence is
suspended till the pendency of the appeal subject to deposit of fine
amount as directed in the order dated 22.07.2023, passed by the Ld.
Trial court, before the said court within two working days.
Appellant is also admitted to bail till the pendency of
the appeal, on furnishing bail bond in the sum of Rs.10,000/- with
one surety of like amount to the satisfaction of Ld. MM
concerned/Link MM/Duty MM.
Put up this appeal for arguments on the pending appeal
on 07.10.2023. Copy of this order be sent to Ld. Trial court and be
given dasti to counsel for appellant.
