Affidavit of admission/ denial of documents and proposed issued not filed despite opportunity. At this stage, Ld. Counsel for plaintiff submits that as the defendants has not filed any documents alongwith their respective WS, therefore, there is no need to file any admission/ denial of documents. Heard. At this stage, Ld. Counsel for defendants jointly submit that they are also not admitting the documents relied upon by the plaintiff except one judgment of CS No.8631/2016. Heard. Admission /denial of documents not conducted. Since pleadings are complete. From the pleading, following notional issues are framed:- 1. Whether the plaintiff is entitled for decree of possession, as prayed for? OPP 2. Whether the plaintiff is entitled for decree of declaration, as prayed for? OPP 3. Whether the plaintiff is entitled for permanent/ perpetual injunction, as prayed for? OPP 4. Whether the present suit is bad for non-joinder of necessary parties? OPD1, OPD2, OPD7 and OPD8 5. Whether the present suit is barred by limitation? OPDs 6. Whether the present suit does not disclose any cause of action? OPD1, OPD2, OPD7 and OPD8 -- 1 of 2 -- 7. Whether the plaintiff has no locus standi to file the present suit? OPDs 8. Relief. No other issue arises or is pressed for. List of witnesses be filed by both the parties within 15 days.
